As far as I understand the law (I’m not a lawyer), most of the time co-habitation does not automatically make it a common-law marriage. In order for it to become a common-law marriage, they need to represent to others that they are married. (Referring to the other as “my husband” or “my wife” for example.)

I really don’t think Claire and Paul consider each other spouses yet. Things operate differently these days (in most places, anyhow.)
