It says “coffee is hot”. It doesn’t say “despite the fact that we’ve been sued hundreds of times for the same thing, the coffee is still hot enough to cause 3rd degree burns should you attempt to remove the lid to add cream and/or sugar and while prying lid manage to spill some in your lap even though we sold it to you through a window knowing full well you’re sitting in a car with no where to put the coffee except between your legs while doing so”.
I’m glad to see that at least a few people know the facts of the case rather than the media jokes. Besides the validity of the injuries, the jury gave a big penalty because McDonalds had been sued many times and still did not change their behavior.
Coffee hot enough to cause third-degree burns is by definition not suitable for human consumption. Yet McDonald’s sold it for human consumption. Hence the lawsuit, and hence McDonald’s losing the lawsuit.
I can see both sides. One could say that people should know that the coffee is hot, no matter what the actual temperature, and treat it accordingly. It’s called personal responsibility. However, after getting multiple complaints, McDonald’s should have seen the benefit of taking the safe route. That’s called being smart and doing the right thing. (It could also be called CYA).
