    never really has been a ban on unusual. .my favorites are dropping the super drunk drivers 10 miles out of town on foot instead of in the tank, cleaning up ALL the dog doo in the park, leaving the kid in the cell while the paperwork is being finished in triplicate by the guy who only types with 2 fingers, the 3 days the woman had to hold up a ‘only an idiot would drive on the sidewalk to avoid a school bus’ shame on me sign .punishment fits the crime thing.

    lawyers are allowed to drop so many jurors without stating reason. Usully they ask do you believe in capitol punishment to determine.

    Cruel punishment was very common on sailing ships. Flogging with a cat of nine tails was very common. Some argued that the food served on those old ships was cruel enough.

    If you sentence ALL speeders to death by stoning, it is not “unusual”, it’s merely “extreme” or “unfitting”. The “unusual” portion is really quite superfluous these days.
