never really has been a ban on unusual. .my favorites are dropping the super drunk drivers 10 miles out of town on foot instead of in the tank, cleaning up ALL the dog doo in the park, leaving the kid in the cell while the paperwork is being finished in triplicate by the guy who only types with 2 fingers, the 3 days the woman had to hold up a ‘only an idiot would drive on the sidewalk to avoid a school bus’ shame on me sign .punishment fits the crime thing.
Cruel punishment was very common on sailing ships. Flogging with a cat of nine tails was very common. Some argued that the food served on those old ships was cruel enough.
If you sentence ALL speeders to death by stoning, it is not “unusual”, it’s merely “extreme” or “unfitting”. The “unusual” portion is really quite superfluous these days.

I guess making your son clean the moat as punishment would count as unusual.

Well there’s no looking “like deer in the headlights” like the jurors in The Buckets today.

@ Night-Gaunt49: That was Giles Corey. He was crushed because he refused to enter any plea.
