I bought a used car from a dealership once. Car had passed it’s safety check earlier that day. Drove it off the lot and then noticed that neither the speedometer or the odometer were working. Drove back to the dealership right away because I was afraid I would have to explain that to a police officer and not be believed.
That argument usually gets a “tell it to the judge” response. You might get the charges dropped (or more likely, reduced to a fine with no points) if it really is broken and you got it fixed and you got the mechanic to sign a statement saying so.
