Had Taney simply decided that slaves have no standing to sue and left it there, it would not have been so devastating. The Supreme Court usually decides one issue at a time. Thanks to Dred Scott, the Supreme Court fell into the background until Earl Warren became Chief Justice.Abe was very smart by bringing up that question. In essence, popular sovereignty had suffered a fatal blow in Kansas. Dred Scott merely provided the funeral. So, in 1860, the last major institution of the Democratic Party split between the sections.
