davecarraa: An exchange depends on a willing buyer and a willing seller. I would not agree to the exchange involving any amount of money, therefore some price imposed by a third party is irrelevant. This is why “none of your business” real estate contracts state “for ten dollars and other good and valuable considerations” – the deal is at least for $10, but setting a price on the other considerations is irrelevant as it may have nullified the contract. Now, if it can be shown that the considerations involved money, then taxing authorities have a case (in in real estate, that is easy enough to prove) but pie for cleaning is not absence proof that the exchange was agreed upon previous to the exchange. Otherwise it is gift and gift and well below the gift tax figure.
