Doesn’t work that way. There is a HUGE difference between a trademark and a copyright. Mickey Mouse is protected by trademark law, while “Steamboat Willie” is protected by copyright. Ending the copyright on “Steamboat Willie” will NOT make it possible for someone else to make an original movie, or even a remake using Mickey Mouse, because Disney has trademarks for their characters. Same applies to nearly all such entities, including Bugs Bunny, Underdog, Woody Woodpecker, and the like.

You’ve got to love the “Originalists”, the Constitution as written, is the be all and end all, except when it isn’t.

And there we were, all believing things would be better with Scalia off the court. The jokes on us.
