Too bad Sotomayer is not a decent candidate for our Supreme Court. The Supreme Court just overturned one of her decisions from the Federal Court because they said her decision was wrong.

Gracie, anyone who tried to hold you back would be crazy.
And the really great thing is that you won’t need affirmative action to make it. You’ll make it on your own merits, not some artificial standard that has to cheat someone else in order for you to make it.

The Supreme Court did not say her decision was wrong. The Appeals Court followed the established precedent and the Supreme Court changed that position. They did not criticize the Appeals Court for deciding as they did or say that Sotomayor was wrong. Sotomayor was being the conservative non-activist in that situation and the Supreme Court were the ones who decided to redefine the situation, making them the judicial “activists.” Details, I know, but important ones.
