Treaties such as the Geneva Conventions are no joke, and it is not just a “quaint document.” The Nuremburg trials were solely based on violations of the Kellogg-Briand pact, to which the US and Germany were both signatories. Japan did not sign the pact. Not all nations are signatories of the Geneva Conventions, either, and I doubt Id would have signed.

If there is no way out but death or surrender and surrender is only prolonged torture, the obvious choice is die fighting, killing as many of the others as you can before you are killed even if if does not further the hopes of winning or harm their hopes of winning. If, on the other hand, decent treatment can be expected, it is possible to surrender, survive and not have to kill others for no purpose.Now, if you HAVE to kill, that is another matter, but anything which reduces that necessity is reasonable.Otherwise, you find yourself thinking, if I let these children live, they will grow up to fight me in ten years, if I let these women live they will bear more children and they will live to fight me in a generation. I had better kill them all just to be safe, even though they are not even combatants.
ROE’s are important in warfare. ROE’s that are in place for purely political reasons and not observed by both sides usually result in unnecessary WIAs and KIAs.
