He’s still standing, conscious, and able to hold a hammer (and presumably able to hear), so doesn’t count.

The warning is not there because people are too stupid to know better. The warning is there so that when somebody sues the manufacturer for the damage caused by striking somebody in the head with a hammer, they can deny liability.
