I would not be surprised if this were based on a real case.
In the one and only law course I ever took I read about a case where a person sued a bicycle manufacturer for an faulty design. The bicycle in question did not have adequate lighting for operating at night. The plaintiff’s son was struck by a motor vehicle (the motorist was also sued).
The bicycle in question was actually a tricycle intended for toddlers, being operated by a toddler on a public street at 11:30 PM.
This case, like many others of its ilk was thrown out on appeal.
Makes me recall that even though Romney wore “mormon magic underwear” that’s supposed to ward off evil, that he still accepted Secret Service protection.
