    In 1985 John Fogerty (former lead singer of Credence Clearwater Revival) was accused of plagiarizing himself. In 1970, while he was with CCR, he wrote a song called “Run Through the Jungle.” A company named Fantasy, Inc. eventually acquired the exclusive publishing rights

    When CCR disbanded in 1972, Fogerty began a solo career with another record label. In 1985, he published “The Old Man Down the Road”, that was released on Warner Brothers Records. Fantasy sued Fogerty for copyright infringement and claimed that “The Old Man Down the Road” was the same melody as “Run Through the Jungle”, and just had new words. The case went to trial and t jury found for Fogerty.

    There was a subsequent battle by Fogerty for the attorney’s fees he sought as provided by the Copyright Act of 1976.

    pschearer: While it is more singable by the average person if within an octave, most go beyond it. Fer’instance, To Anachreon in Heaven, which has been plagiarized for some frequently sung more familiar ditty which is essentially unsingable by the average person. (Robert Merrill said he required a six-weeks advance warning before he would sing it in public, in order to prepare it property.)

    Legend has it that some tyro songwriter was pitching his latest piece to a music publisher when Chico Marx burst into the office (he’d been out in the waiting room), basically pushed the kid off the piano, and cried, “Hey, listen to this song I just wrote!”, whereupon he played and sang the kid’s work note for note and letter for letter. Kid was shocked and crushed to think he had ripped off a song from a famous entertainer like Chico. What he didn’t know was that Chico had an outrageous ear and could play and/or sing anything he heard after hearing it only once, even through a waiting-room door.

    Bob: This is not really in the same category. First, Meridith Wilson wrote both of them, and second, in case no one noticed, they were together as counterpoint in the twin soliloquy in the last act of The Music Man..pschearer: Well, all rules are off if you are going to bring in Zauberflotte – or Lakme, either.
