The first think the lawyer will asks is who has been paying the taxes on this diner all these years. The second thing he will ask is whether the bulldozers are there on account of a writ of eminent domain. The third thing he will ask is how Corky plans to pay him, after the diner is torn down.
If there’s a writ of eminent domain, then it doesn’t matter whether Corky or Wilmer owns the property. The diner comes down, because the government has ruled that they need the property. The deed just determines who gets paid for the property that the government took over.
This reminds me of a VERY similar GA storyline from years ago! Pert tried to take over Rufus’ shack and junkyard over a property dispute where Pert believed he actually owned the land! Turned out he did NOT, as Walt pointed out that the deed specified Pert’s land as being ONE INCH off of Rufus’ property (simplistic, but that’s GA for you, enjoyable as it is). Anyway, Pert arranged for a wrecking ball to demolish Rufus’ shack (bit excessive, yes, but again, it’s GA). Rufus stands guard steadfast on his land while the crane operator tries to work the ball AROUND Rufus – yet the guy was SO inept, he wound up wrecking his own rig, comically! Walt and Pert arrive just in time to clear up the mess, and Rufus’ place is left alone. Again, similar to what’s happening right here at Corky’s!

The lawyer can petition the court for an emergency order prohibiting further demolition until the legal process can sort this out.
