It turns out that someone has ALREADY tried the “I identify as a black woman” (that person had always identified as female). She got caught and lost quite a bit of her life as she wished she knew it. I get that Ramirez has to push past the limits of reality (this is also known, by the way, as “lying”) to make his point as strongly as possible, but let’s just remember that he is lying, here.
As for the “identify as female” part? It’s generally well known that people who do eventually do that have been considering it more or less “forever” — with exceptions for the (overly religious) folks who can’t stand the IDEA of being misgendered even though they ARE misgendered. Garland has never shown the slightest sign of any such thing. And of course, as @VegaAlopex points out, he WOULD BE on the Supreme court if everyone (Mitch McConnell) in the Senate had behaved lawfully.
To be qualified for the Supreme Court you have to understand and respect Constitutional guarantees of civil liberties. That ain’t Garland’s strength. He could be up for a court appointment in Putin’s Russia, however.
