The only thing those fingerprints establish is that Hammie has held the football at some time in the past. Since it is his football, that is only reasonable. There are probably prints from Darryl and possibly Wanda, Zoe and even Wren. I really doubt she could lift prints off it anyway, due to the pebbled surface.
Dusting for fingerprints would prove nothing. Since it’s Hammie’s football, his fingerprints would naturally be all over it. Plus, I doubt the simple dusting powder and tape available in a child’s kit would be good at lifting a print from a textured surface like a football.
And unless Hammie’s fingerprints were already on file, they would have none to use for comparison, unless Wanda compelled him to submit to giving a sample.
Of course, Hammie has so many prior convictions, Zoe’s case would have a huge believability factor.
I don’t think the case wouldn’t hold up in court. It’s Hammie’s football, so obviously his prints would be on it. Her prints and Darryl’s prints would probably be on it, too. Without a corroborating witness, it’s just her word against his. Prior offenses can’t be considered in adjudicating this particular case.
However…
Since the matter would fall under the jurisdiction of “MacPherson house law,” the statutes may be different. Result: the time-out chair.
