In our province, that is illegal for that category of occupation. Employment Standards says you cannot be categorized as an independent contractor if the Boss dictates the hours or location of work performed, or provides the equipment- in this case, the POS terminal, etc.
A lot of small trucking company owner operators try paying their employees with a 1099. Then they think they don’t have to withhold taxes or pay health insurance, unemployment insurance or workman’s comp.
“In that case, my hourly rate just went up to reflect that, retroactively. And, oh, by the way, I know about all your little tax schemes and I’m sure the tax man would find them very interesting. I trust there will be no complaining about my new rate.”
I got converted from employee to contractor for a while, but then two years later the company got in trouble for the conversions and had to convert us back to employees. HR, ever anxious to propagate upper management’s BS, had us sit through employee orientation sessions and pointed out several times how well the company was doing, since the orientation sessions that month had been the biggest the company had conducted in years.

It is astounding how many employers try to get away with that horse excrement.

Shush. Hear that? It’s one of your future contractors running out of your office yelling " Sic semper Tyrannis!"
