It’s a fallen silver maple and you won’t get much from a dead leaf.

Why does he want to sue a silver maple when it was a pin oak leaf (sort of) that fell on him. Note to lazy cartoonist: If you are going to mention a specific species of tree, at least take the effort to draw the corresponding leaf.

@tjmcnitt: that may be the point. People often want to sue over unavoidable natural damage but just pick a target out of a hat. Doesn’t have to be accurate – it’s just the I’m gonna sue somebody knee jerk reflex

Silver Maple, Pin Oak, regardless, trees don’t have deep pockets. Go after the real estate owners.
