How could Wiley even write the title?

Water Rights are covered under three general legal theories. Which one applies to you depends on which state you live in.

Riparian Right: Water is inexhaustible resource, if it is available on your property, take what you need and leave the rest. Sort of like air.

Prior Appropriation Right: Water is a limited resource, if it is available on your property, take what you need, leave the rest, in time of drought first users in time get their established use first, when is used up, remaining users must do without.

Proscriptive Right: Water is a limited resource. To use the resource, you must show that your use is “Reasonable, Beneficial, and in the Public Interest” (wording from Florida Water Law) having shown that, a state agency issues a permit for your water use. In time of drought, the state agency apportions the available water to those uses that best meet the criteria.

There are still Water Wars, fought by “hired gun slingers called ‘Water Lawyers’.”
