I love how people sometimes think the IP system works. No company would attempt to do something like this, even the scummiest of the scummiest, simply because they are opening themselves up to MASSIVE legal costs, delays, and waste of resources.
If the patent is pending, then ownership of the idea has been established. The only thing that can be debated now is whether the existing patents already cover the idea or the idea is obvious to one skilled in the art. And that’s done by the USPTO.
The best that the competitor can hope for is that the claims set of the pending patent (which is published) somehow doesn’t cover something or states requirements that can be omitted.
Let’s not even raise the issues of FDA approval or manufacturability.
