Benson is very annoyed that Breyer chose to give Biden the opportunity to replace him before the midterms. Be sure that McConnell, Manchin, et al will do everything they can to delay it until after the newly elected Senators are seated.

Concretionist, there are 34 senate seats up for grabs this year. 20 Republican, and 14 Democrat. 5 of the Republican seats will be vacant, due to retirement, and 1 Democrat. Barring some wildly outrageous Democratic catastrophe, delay by Manchin and McConnell won’t change the very negative outlook for the Republican party in the Senate. How very sad for them…I weep to think of their misery…BWAHAHA!! The outlook in the House isn’t so likely to be cheerful, unfortunately, but it is the Senate that will decide who the replacement justice will be.

My bet is VP Harris will be nominated to replace Breyer. It solves several problems facing Democrats. For one it gives the unpopular VP a dignified exit ramp and allows an opening for a stronger candidate to replace Biden when he can’t do this anymore.

No one tell Lisa McConnell isn’t going to get to choose the next Justice.

The big IF is if Senator Sinema or Manchin get an offer from the republicans they can’t refuse and jump ship and McConnell becomes majority leader=no judges confirmed until 2025.

The Senate Democrats in question all voted against Ada E. Brown, former President Trump’s nominee for district judge of the northern district of Texas.

Brown, a Black woman, was confirmed in September 2019 by a vote of 80-13, with the 13 “nay” votes coming from Democratic Senators Chuck Schumer, Tammy Baldwin, Richard Blumenthal, Sherrod Brown, Maria Cantwell, Catherine Cortez Masto, Kirsten Gillibrand, Mazie Hirono, Ed Markey, Patty Murray, Brian Schatz, Debbie Stabenow and Ron Wyden.

I hope the dims confirm a judge who can reverse Joe’s own hypocritical policies.

So Breyer finally knuckled under to the brow beating he was getting from the Democrats. Can’t say I blame him. On a personal level this is probably a good thing for him considering his age. Let him retire, spend his remaining years with his grandkids, family and write his memoirs. I felt that Ginsberg should have done the same thing many years ago politics be damned.
