Ralph can ignore him. All notices of action from the HOA would have to be in writing and they would give him at least 30 days to correct the issue before they fined him.
I’ve never left a comment for these sorts of things, but I have to here. The Migratory Bird Treaty Act makes it illegal to do such things as washing down this nest. I’m glad to see I wasn’t the only one to note this.
St. Kevin & the Blackbird: The holy Kevin, while avoiding the society of his fellow men during the season of Lent, as his custom was, devoted his time to reading and prayers, in the desert, occupying a small hut which did nothing but keep out the sun and rain, giving himself up to contemplation only.
And while he was lifting up his hand to heaven through the window, as he used to do, a blackbird by chance alighted on it, and treating it as a nest, laid an egg there. And the Saint showed such compassion towards it, out of his patient and loving heart, that he neither closed his hand nor withdrew it, but indefatigably held it out and adapted it for the purpose until the young one was fully hatched.
Mud nests mean swallows and migrating and songbirds are protected by Federal Law. If he removes the nest (or has anyone else do it), he faces thousands in fines and time in jail. Stupid HOA and dumb subject. The ONLY nests that can be disturbed with impunity are English sparrow and starling nests as both are imported birds.
HOAs: created to enforce deed restriction that perpetuated racism and religious bigotry; now existing to give nosy, self-important (noun not allowed by the site)s a vehicle for being their nosy, self-important (adjective not allowed by the site) selves.
I don’t get the American concept of home owners associations. Although SOMETIMES, not often, the state of some houses leaves something to be desired. What happens if a resident doesn’t want to join the association?

Another reminder of why people dislike HOA’s…

He doesn’t even get a chance to call animal control and have the birds removed humanely?

If he’s that mad about the owl, wait until he (and Ralph) find out about the duck.

Ralph, call the FEDS and report him for trying to force you to violate the Migratory Bird Treaty Act.

Disturbing the nest of a protected species could bring fines and jail time.

Why get rid of the nest? The eggs will hatch and the birds fly away soon enough.

HOAs are a scam. Mine says you can have as many tarps lying around your yard as you want and they can be in any condition.
As long as they’re not blue. Blue tarps are not to be visible from the road. Figure that one out.

HOAs; the bane of suburban life! To be avoided if at all possible.

No such HOA rule. Now if it was an Eagle’s nest, maybe.

Around here, if a bird builds a nest, you can’t take it down until fall after the nest has been abandoned by the fledglings.
