I write separately to highlight another way in which this prosecution may violate our constitutional structure. In this case, the Attorney General purported to appoint a private citizen as Special Counsel to prosecute a former President on behalf of the United States. But, I am not sure that any office for the Special Counsel has been “established by Law,” as the Constitution requires. Art. II, §2, cl. 2. By requiring that Congress create federal offices “by Law,” the Constitution imposes an important check against the President—he cannot create offices at his pleasure. If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President.

Was just reading the complete SCOTUS decision on Presidential Immunity. Jack Smith is in deep trouble. His appointment is totally illegal, his funding is illegal, and he personally has no standing as a prosecutor he is a private citizen. There is no congressional position authorized to place him in, Garland cannot make one up. The regulations Garland rubbered to make the appointment are only meant to be used to temporarily fill non judicial positions in the FBI. What’s more in his zeal to make a big show out the raid on Mar-a-Largo the FBI and DOJ officials lead to the spoliation of the evidence. There were 15 boxes of records that were securely stored at Mar-a-Largo under lock and key. The US Archives knew about them and their contents. The Presidential records secretary was in communications with the National Archives about their storage. To make a big show on the MSM one of the boxes was dumped out on the floor and SF-703 security cover sheets carried in by DOJ officials were placed on top of the pile. The other boxes were rifled through stuffed back in the boxes randomly these files were not documented or photographed in anyway. The Trump defense lawyers in discovery requested a catalog of these records they needed some of them for Trumps defense, They already had a court certified list. Jack Smith refused to supply any of the requested records. It was than found out what happened. This alone is grounds for instant dismissal of charges. It is wonderful to watch Biden’s out to get Trump army going down in flames. It is even better to listen to those with TDS caterwauling in sackcloth and ashes.

Secondly, an Inspector General can be appointed to oversee SCOTUS.

Thirdly, justices Alito, Thomas, and Roberts can be impeached.

Unfortunately, all of these actions depend on a BLUE wave in November 2024 – U.S. presidency, House, and Senate
