I’m a lawyer, and I’ve never heard of implied trespass. Implied CONSENT to trespass, yes, but Monty never entered on the lawyer’s property, so there was no trespass. On the other hand, a lawyer having an open conversation with a client which can be overheard by passers by has likely waived privilege to the information being discussed, and could be sued for professional negligence by his client.

I think that I might have answered, “Performance Art?” to the initial question to either A. remind him that the choice to be public was his, or B. thank him for the entertainment.
I had to ask my neighbor to tone down the “important business meetings” he was having over the Internet, outdoors, right outside my window. He spent over a year remodeling his big house. I didn’t complain about that but he can take the meetings indoors.
Actually, I am not. Nor do I think you are. Explain the legal concept of an actual trespass versus an implied trespass if you please. Is that concept applied to both chattels and realty, or just one of them?…..
